Q: Can the birthparents make a claim for our child at a later date?

A: Texas is considered an "adoption friendly" state. The birth mother and birth father (if he is married to the birth mother) must wait 48 hours after the birth of the child to sign an Affidavit of Relinquishment of Parental Rights. An unmarried birth father may sign a Waiver of Interest even before the birth.

Both the Affidavit of Relinquishment of Parental Rights and the Waiver of Interest are IRREVOCABLE the moment they are signed. There is no "grace period" after signing the affidavits during which a birth parent can change her or his mind.
